Yes, this is a bug. The search should be on the root and not in the category tree. There is no way to fix this with a snippet. I have to fix the logic so the form action attribute is properly set to the page root when in the category tree. This change will require some testing to make sure I do not break the other logic involved. I will not be able to get to this until next week because of the complexity involved.
